Judge denies xAI's bid to dismiss NAACP lawsuit over Southaven gas turbines
A federal judge in Mississippi on Friday denied xAI's motion to dismiss the NAACP's Clean Air Act lawsuit over the gas-turbine power plant in Southaven that supplies its Colossus 2 data center. Chief Judge Debra M. Brown rejected xAI's argument that citizen suits are unconstitutional and held that the plant's so-called temporary turbines are not exempt "mobile sources," disagreeing with the Mississippi regulator's earlier view that they needed no air permits. The ruling, which comes less than two weeks after the court refused the Justice Department's request to end the case, does not decide whether xAI broke the law. The NAACP's request for a preliminary injunction is still pending.
